1. Prices

There is no VAT charged on any item including delivery. All prices are shown in £ pounds sterling. Prices are subject to change.

2. Delivery

The delivery time quoted is from receipt of order or approval of our artwork where applicable and may be subject to delay beyond our control. Time shall not be of the essence and the purchaser shall not be entitled to claim compensation or damages as a result of delay in delivery.

3. Cancellation

Cancellationmay be made with written consent on terms that indemnify Embroidery Loft LLP against losses.

4. Ownership

The ownership of goods shall not pass to the buyer until all sums owing in respect of any have been paid.

5. Risk

Risk shall pass to the buyer on delivery to the address stated on the order.

6. Loss or Damage

Any loss or damage must be notified to Embroidery Loft LLP in writing within four days of the delivery date. Embroidery Loft LLP does not accept any liability for items lost or damaged in transit when delivered via a third party carrier.

7. Design and Specification

Design and specification may be subject to alteration without notice. It is assumed that goods specified by the customer are sufficient and suitable for the purpose for which the goods were ordered.

8. Samples

Where samples are supplied these will be charged at the time of request at blank garment rate plus carriage. The charge for the sample may be deducted from your final order value if previously agreed.

9. Artwork

Artwork must be approved by the customer before application. Where so approved any further changes may be charged for accordingly. Embroidery Loft LLP does not accept liability for errors, howsoever caused, which are evident in any proof and not indicated by the client at the proof approval stage. Clients are liable for all relevant costs incurred in correcting such mistakes once the proof has been approved.

10. Warranty and Guarantee

Any period and terms and conditions are limited to that provided to Embroidery Loft LLP by their supplier(s) for the particular goods ordered and shall be passed onto the customer. No liability will be accepted by Embroidery Loft LLP for consequential loss or damage or any other expenses resulting.

11. Returns

All returns must be agreed with Embroidery Loft LLP in writing and be registered under its returns procedure. Embroidery Loft LLP reserves the right to reject goods arriving at its premises that are not so recorded or clearly marked with the correct returns number. Returns will be subject to a handling fee.

12. Login Account

You can create an account login which requires the setting up of a password protected account. During set up of the account you are responsible for the accuracy and legality of all the data provided to open it. Once established you are responsible for maintaining the accuracy of the information which you can update on-line or contact us to do so.

In setting up the account you accept that you are responsible for: managing access to the account, the confidentiality and security of both the account and password, restrictions of use and full responsibility for all activities that take place on the account. You also accept that you should inform us immediately if you have any reason to suspect that the password has been made known to unauthorised users or will be used in an unauthorised manner. Embroidery Loft LLP reserves the right to remove access to the e-commerce facilities, terminate accounts, remove or edit content and cancel orders at its discretion.

13. Credit Card Payments

All credit card payments are taken in good faith. Fraudulent usage of this facility will be immediately reported to the relevant authorities and will be taken to have broken all contract terms. Deliveries to addresses other than the card holder’s invoice address may be declined.

14. Returns and Cooling-Off Period

In addition to section 11 of the Embroidery Loft LLP, standard, Terms and Conditions regarding returns, there is no cooling-off period for goods supplied with a design applied as per an artwork brief accepted by email – a copy of which will be held by us as proof of acceptance. This is a special condition which applies as the goods cannot be returned to stock for resale.

15. Purchase and Delivery

In addition to sections 1,2 & 3 of Embroidery Loft LLP, standard, delays in processing orders may be beyond the control of Embroidery Loft LLP. Where more than one product is ordered Embroidery Loft LLP may part ship but will not make an additional delivery charge to complete the order. If Embroidery Loft LLP is not able to deliver within 28 calendar days of the order placement then you will be notified by email and given the opportunity to cancel the order with a full refund without reasonable delay.

16. Position of Decoration

The position and finish of your decoration may vary from item to item. This is because all of our products are positioned by hand, our personalization team will always do their best, however there is no way of the finished decoration to be in the exact same position / angle on every item. Each item that leaves Embroidery Loft LLP has been inspected by our quality control team and has been passed as acceptable within the tolerance.

17. Artwork Copyright etc.

By uploading artwork to the site, the customer confirms that they have permission to use the artwork, and that it doesn’t contravene any copyrights, trademarks or other licences. It is the customer’s responsibility to ensure that artwork uploaded is of high enough quality and resolution to be printed at the size requested. We will not be responsible for poor design results when low quality artwork has been provided. If you’re unsure whether your artwork is high enough resolution, please contact us before placing an order. Images which look OK at screen resolution will not always give a good design result. We will digitize or vectorize images as they are uploaded, and will not make any changes (eg remove background) unless agreed by email.

Please supply your artwork as an original vector files (.ai or .eps) for best results. .jpeg or pdf also acceptable but no photographs please.

18. Colours

Embroidery Loft LLP will try and match the colours of the artwork supplied to the best of our ability but will not be held responsible for the fact that thread colours vary considerably. If the colours of your design are critical please supply Pantone colours, however, with embroidery we can only match thread colours as best we can as there is not always an exact shade match to Pantone colours.

19. Garments

Garments offered on the site are subject to availability. In some cases, due to garments being out of stock, it may be necessary to substitute them for an alternative. Alternative garments will be of at least an equivalent quality as the original chosen garment, and we will try to notify the customer of any necessary garment change when time allows. Garment sizes given on the site are provided by the manufacturer. They are reasonably accurate and ‘industry standard’, but are given as a guide only. We are unable to refund or exchange orders where an incorrect size has been ordered. Please ensure you order the correct size(s). Contact us if you need clarification of garment sizing. Garment images are for illustrative purposes only, and may not accurately represent the actual garment due to limitations of the web display processes, particularly in relation to garment colours. If garment colour is critical, please contact us before placing an order. Embroidery Loft LLP take no responsibility for any mistakes or mishaps to garments supplied by customers and not supplied by Embroidery Loft LLP.

20. Garment Care

Wash garments according to care labels on garments, inside out, and always iron the garment inside out.

21. Returns Policy

Personalised items will only be eligible for a refund or exchange if the garment itself is faulty. Personalised and tailor-made items are exempt from the Consumer Contracts Regulations.

22. Claims

Any claims arising from damages, delay or partial loss in transit must be made via email so as to reach us within 5 working days of delivery. All claims with regard to the quantity of the goods must be made via email so as to reach us within 5 working days of receipt of goods, or such goods shall be deemed to comply with the terms of the contract. Claims in respect of non-delivery must be made so as to reach us within 25 working days from placement of order.

23. General

These terms and conditions apply to all orders and supersede all others. By using this site or placing an order with us, you expressly accept and agree to abide by all the terms and conditions contained in this statement. Please read through them carefully before placing any order, if you do not agree with any of these terms and conditions please do not place your order with us. We reserve the right to vary these terms and conditions from time to time without notice.
